SELECTION CRITERIA
Section 2.3
Establishes the basic selection criteria for calculated services.
2.3.1. States that the built area of each residence is calculated at 100%; that is, built area is understood to be closed built area. Residence is understood to be any property built in the scope of the La Marina Special Plan, such as apartments, ats, studios, penthouses, houses, townhouses, semi-detached houses, commercial premises, storerooms or any other type of building regardless of its use, be it residential, tertiary, etc.
2.3.2. States that terrace areas are calculated at 50%; which is to say that fty percent of the built area of terraces, including any other similar denomination like porches, solarium, patio or any other name for any other built area, regardless of its use (residential, tertiary, etc. ), that have at least three sides not enclosed.
2.3.3.States that landscaped areas, whose exclusive use and enjoyment is established for other properties in each case, are calculated at 25%; which is to say, twenty-ve percent of the built area of landscaped areas, including the proportion corresponding to each owner based on their ownership percentage, of landscaped areas in the development and those common to the development plot and/or owners' association. Therefore, the calculation includes all landscaped areas included in the development's plots determined in the La Marina Special Plan.
The information used on calculated areas in order to charge the set fee or renewable annual fee, as a fee for maintenance and services per calculated square metre, is validated based on the following order of priorities according to the availability of the corresponding docuemnts at the time of the first payment (coinciding with the property's first certificate of occupancy)
ORDER OF PRIORITIES
1. Gross area of the property, applying the criteria established in the REM Rules and the interpretations stated above.
2. Calculated area that appears in the Public Deed in the section on Provisional REM Fee.
3. Calculated area deduced from partial information appearing in the Public Deed, applying the criteria established in the REM Rules and the interpretations stated above.
